Workplace Investigations

Collaborative Options provides 3rd party neutrals to conduct investigations upon notice of claims of harassment, discrimination, misconduct; or, in the event of a regulatory inquiry or charge, labor unrest or contract disputes. Our investigators are skilled, experienced and discrete HR professionals and/or licensed attorneys.

Collaborative Options provides organizations with an Investigative Report which includes:

  • Full documentation of methodology including time, place and scope of inquiries; persons interviewed, documents reviewed; and, a compilation of signed, dated and witnessed statements
  • Full report of discovered information, observed behaviors, mental impressions and details of any discrepancies and/or conflicting statements
  • Assessment of the conflict including identified interests of the disputants or complainant(s), potential for resolution and recommendations to mitigate or resolve the dispute or complaint(s)

Involving Collaborative Options at the investigatory stage reduces risk and improves the opportunity for a non-litigated resolution.

Note: The Investigative Report does not provide legal guidance or consider the application of internal policies, procedures, practices and work rules. This work is appropriately retained by the HR staff and corporate legal counsel.

Since the confidentiality of the Investigative Report is subject to the rules of discovery, the prevailing view is that assertion of work product privilege may be stronger if 3rd party neutrals are hired by and report to legal counsel.
